17 insert:
18 Section 5. The Department of Management Services may
19 not implement a prior-authorization program or a
20 restricted-formulary program that restricts a non-HMO
21 enrollee's access to prescription drugs beyond the provisions
22 of section 110.12315(3), Florida Statutes, as amended by act,
23 which relate specifically to generic equivalents for
24 prescriptions and the provisions of section 110.12315(5),
25 Florida Statutes, as amended by this act, which relate
26 specifically to starter-dose programs or the dispensing of
27 long-term maintenance medications. The prior-authorization
28 program expanded pursuant to section 8 of the 1998-1999
29 General Appropriations Act is terminated. If this section
30 conflicts with any General Appropriations Act or any act
31 implementing a General Appropriations Act, the Legislature
