11  Senator Brown-Waite moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 30, between lines 2 and 3,

15

16  insert:

17         Section 4.  Effective upon this act becoming a law,

18  paragraph (e) is added to subsection (2) of section 110.12315,

19  Florida Statutes, to read:

20         110.12315  Prescription drug program.--

21         (2)

22         (e)  The Division of State Group Insurance may not

23  implement a prior-authorization program or a

24  restricted-formulary program that restricts a non-HMO

25  enrollee's access to prescription drugs beyond the provisions

26  of paragraph (b) related specifically to generic equivalents

27  for prescriptions and the provisions of paragraph (d) related

28  specifically to starter-dose programs or the dispensing of

29  long-term maintenance medications. The prior-authorization

30  program expanded pursuant to section 8 of the 1998-1999

31  General Appropriations Act is terminated. If this paragraph
