1 A bill to be entitled
2 An act relating to assisted living facilities;
3 amending s. 400.411, F.S.; requiring an
4 applicant for initial licensure to document
5 capacity to maintain specified summertime
6 temperatures in the facility; requiring current
7 licensees to comply with those standards within
8 a specified period; providing an effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Present subsections (11), (12), and (13) of
14 section 400.411, Florida Statutes, 1998 Supplement, are
15 renumbered as subsections (12), (13), and (14), respectively,
16 and a new subsection (11) is added to that section, to read:
17 400.411 Initial application for license; provisional
18 license.--
19 (11) The applicant must furnish documentation that the
20 facility is equipped with a functioning air conditioning
21 system capable of maintaining indoor temperatures at anywhere
22 between 65 and 75 degrees Fahrenheit during the summer period.
23 Section 2. An assisted living facility licensed before
24 July 1, 1999, must comply with section 400.411(11), Florida
25 Statutes, within 6 months after that date and, before
26 compliance, must do whatever is necessary to maintain the
27 indoor temperature of the facility at between 65 and 75
28 degrees Fahrenheit during the summer period.
29 Section 3. This act shall take effect July 1, 1999.
