11  The Committee on Comprehensive Planning, Local and Military

12  Affairs recommended the following amendment:

13

14         Senate Amendment (with title amendment) 

15         On page 1, line 26, through page 2, line 20, delete

16  those lines

17

18  and insert:

19         (2)  A minor may not ride on the bed of a pickup truck

20  or flatbed truck unless the truck has factory-installed

21  seating in the bed, or has been modified to include in the bed

22  secure seating and safety restraints that would prevent the

23  minor from falling, jumping, or being thrown from the truck,

24  and the minor is securely restrained in such seating. No

25  person shall ride on any vehicle upon any portion thereof not

26  designed or intended for the use of passengers. This provision

27  shall not apply to an employee engaged in the necessary

28  discharge of a duty or to a person or persons riding within

29  truck bodies in space intended for merchandise. Any operator

30  of a pickup truck or flatbed truck person who violates the

31  provisions of this subsection shall be cited for a nonmoving

 1  violation, punishable as provided in chapter 318. However,

 2  nothing in this section may be construed to prohibit a local

 3  governmental entity from enacting an ordinance that prohibits

 4  any person other than an employee engaged in the discharge of

 5  his or her duties from riding in or otherwise occupying the

 6  open bed of a truck being operated upon any street or highway

 7  within its territorial limits. A person who violates such an

 8  ordinance is subject to the penalties provided in this

 9  subsection.

13  And the title is amended as follows:

14         On page 1, lines 6-8, delete those lines

15

16  and insert:

17         met; deleting provisions prohibiting a person

18         from riding in any portion of a vehicle not

19         designed for the use of passengers; providing

20         penalties; authorizing local governmental

21         entities to enact certain ordinances; providing

22         an effective date.
