13         Senate Amendment (with title amendment) 

14         On page 3, lines 20 and 21, delete those lines

15

16  and insert:

17         Section 4.  Subsection (16) is added to section 120.80,

18  Florida Statutes, 1998 Supplement, to read:

19         120.80  Exceptions and special requirements;

20  agencies.--

21         (16)  AGENCY FOR HEALTH CARE ADMINISTRATION.--A

22  hospital may initiate or intervene in an administrative

23  proceeding involving the issuance or denial of a certificate

24  of need for an organ transplantation program upon a showing

25  that an established organ transplantation program at the

26  hospital will be substantially affected by the issuance of the

27  certificate of need to a competing program or facility within

28  the same service planning area delineated under rules adopted

29  by the Agency for Health Care Administration.

30         Section 5.  This act shall take effect upon becoming a

31  law, and sections 1, 2, and 3 shall apply only to contracts
