  1                      A bill to be entitled

  2         An act relating to legislative employees;

  3         amending s. 121.055, F.S.; authorizing the

  4         President of the Senate and the Speaker of the

  5         House of Representatives to designate

  6         additional employees of their respective house

  7         who may be required to participate in the

  8         Senior Management Service Class of the Florida

  9         Retirement System; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Paragraph (c) of subsection (1) of section

14  121.055, Florida Statutes, 1998 Supplement, is amended to

15  read:

16         121.055  Senior Management Service Class.--There is

17  hereby established a separate class of membership within the

18  Florida Retirement System to be known as the "Senior

19  Management Service Class," which shall become effective

20  February 1, 1987.

22         (c)1.a.  Effective January 1, 1990, participation in

23  the Senior Management Service Class shall be compulsory for up

24  to 75 nonelective positions at the level of committee staff

25  director or higher or equivalent managerial or policymaking

26  positions within the House of Representatives, as selected by

27  the Speaker of the House of Representatives, up to 50

28  nonelective positions at the level of committee staff director

29  or higher or equivalent managerial or policymaking positions

30  within the Senate, as selected by the President of the Senate,

31  all staff directors of joint committees and service offices of

  1  the Legislature, the Auditor General and up to 9 managerial or

  2  policymaking positions within his or her office as selected by

  3  the Auditor General, and the executive director of the

  4  Commission on Ethics.

  5         b.  Effective January 1, 2000, participation in the

  6  Senior Management Service Class shall be compulsory for up to

  7  175 nonelective positions within the Senate which are selected

  8  by the President of the Senate and for which participation is

  9  not compulsory pursuant to sub-subparagraph a. and up to 275

10  nonelective positions within the House of Representatives

11  which are selected by the Speaker of the House of

12  Representatives and for which participation is not compulsory

13  pursuant to sub-subparagraph a.

14         2.  Participation in this class shall be compulsory,

15  except as provided in subparagraph 3., for any legislative

16  employee who holds a position designated for coverage in the

17  Senior Management Service Class, and such participation shall

18  continue until the employee terminates employment in a covered

19  position.

20         3.  In lieu of participation in the Senior Management

21  Service Class, at the discretion of the President of the

22  Senate and the Speaker of the House of Representatives, such

23  members may participate in the Senior Management Service

24  Optional Annuity Program as established in subsection (6).

25         Section 2.  This act shall take effect January 1, 2000.

28                          SENATE SUMMARY

29    Authorizes the President of the Senate to designate
      additional employees of the Senate, and the Speaker of
30    the House of Representatives to designate additional
      employees of the House of Representatives, for whom
31    membership in the Senior Management Service Class of the
      Florida Retirement System will become compulsory.
