11  The Committee on Health, Aging and Long-Term Care recommended

12  the following amendment:

14         Senate Amendment 

15         On page 10, between lines 28 and 29,

16

17  insert:

18         (e)  The requirements in this subsection do not apply

19  to:

20         1.  A facility that is certified under chapter 651 and

21  has a licensed home health agency used exclusively by

22  residents of the facility; or

23         2.  A retirement community that consists of residential

24  units for independent living and either a licensed nursing

25  home or an assisted living facility, and has a licensed home

26  health agency used exclusively by the residents of the

27  retirement community; provided the comprehensive emergency

28  management plan for the facility or retirement community

29  provides for continuous care of all residents with special

30  needs during an emergency.
