14         On page 4, between lines 10 and 11

16  insert:

17         Section 3.  Paragraph (b) of subsection (2) and

18  subsection (3) of section 234.021, Florida Statutes, are

19  amended to read:

20         234.021  Hazardous walking conditions.--

21         (2)  IDENTIFICATION.--

22         (b)  It is intended that district school boards and

23  local governmental entities work cooperatively to identify

24  conditions that which are hazardous to students who must walk

25  to school.  The It is further intended that state or local

26  governmental entities having jurisdiction are requested to

27  make appropriate budgetary allocations to correct such

28  hazardous conditions within a reasonable period of time after

29  the local school district notifies the responsible

30  governmental entities of the hazardous conditions.

 1  CONDITIONS.--

 2         (a)  Walkways parallel to the road.--

 3         1.  It shall be considered a hazardous walking

 4  condition with respect to any road along which students must

 5  walk in order to walk to and from school if there is not an

 6  area at least 4 feet wide adjacent to the road which has at

 7  least a 4-foot, wide reasonably flat and obstacle-free, having

 8  a surface upon which students may walk without being required

 9  to walk on the road surface.  In addition, whenever the road

10  along which students must walk is uncurbed and has a posted

11  speed limit of 55 miles per hour, the area as described above

12  for students to walk upon shall be set off the road by no less

13  than 3 feet from the edge of the road.

14         2.  The provisions of Subparagraph 1. does do not apply

15  when the road along which students must walk:

16         a.  Is in a residential area which has little or no

17  transient traffic;

18         b.  Is a road on which the volume of traffic is less

19  than 180 vehicles per hour, per direction, during the time

20  students walk to and from school; or

21         c.  Is located in a residential area and has a posted

22  speed limit of 30 miles per hour or less.

23         (b)  Walkways perpendicular to the road.--It shall be

24  considered a hazardous walking condition with respect to any

25  road across which students must walk in order to walk to and

26  from school:

27         1.  If the traffic volume on such road exceeds the rate

28  of 360 vehicles per hour, per direction (including all lanes),

29  during the time students walk to and from school and if the

30  crossing site is uncontrolled. As used in For purposes of this

31  subsection, the term an "uncontrolled crossing site" means is

 1  defined as an intersection or other designated crossing site

 2  where no crossing guard, traffic enforcement officer, or stop

 3  sign or other traffic control signal is present during the

 4  times students walk to and from school.

 5         2.  If the total traffic volume on such road exceeds

 6  4,000 vehicles per hour through an intersection or other

 7  crossing site controlled by a stop sign or other traffic

 8  control signal, unless crossing guards or other traffic

 9  enforcement officers are also present during the times

10  students walk to and from school.

11         3.  If the roadway has six or more through lanes,

12  excluding turn lanes, and the traffic volume exceeds 3,000

13  vehicles per hour through an intersection, whether or not

14  crossing guards or other enforcement officers are also present

15  during the times students walk to and from school.

17  Traffic volume must shall be determined by the most current

18  traffic engineering study conducted by a state or local

19  governmental agency.
