6 contracting; amending s. 394.78, F.S.;
7 providing rulemaking authority; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (2) of section 394.74, Florida
13 Statutes, is amended to read:
14 394.74 Contracts for provision of local alcohol, drug
15 abuse, and mental health programs.--
16 (2) Contracts for service shall be consistent with the
17 approved district plan and the service priorities established
18 in s. 394.75(4).
19 (a) Notwithstanding s. 394.76(3)(a) and (c), the
20 department may use unit-cost contracting, including case rates
21 methods of payment in its contracts, for purchasing mental
22 health and substance-abuse client services through June 30,
23 2002. The department's unit-cost contracting system must
24 account for patient fees that are paid for on behalf of a
25 specific client and that are earned and used by the provider
26 for those services funded in whole or in part by the
27 department.
28 (b) The department may reimburse actual expenditures
29 for start-up contracts and fixed capital outlay contracts in
30 accordance with contract specifications.

1 Section 2. Subsection (6) is added to section 394.78,
2 Florida Statutes, 1998 Supplement, to read:
3 394.78 Operation and administration; personnel
4 standards; procedures for audit and monitoring of service
5 providers; resolution of disputes.--
6 (6) The department shall adopt by rule standards for
7 contracting, budgeting, methods of payment, and the accounting
8 of patient fees that are earned on behalf of a specific
9 client.
10 Section 3. This act shall take effect July 1, 1999.
