2 An act relating to public education capital
3 outlay funding; amending s. 235.435, F.S.;
4 providing for PECO funding based on projected
5 student membership growth to be determined by
6 actual and anticipated development; providing
7 an effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Paragraphs (a) and (b) of subsection (3) of
12 section 235.435, Florida Statutes, 1998 Supplement, are
13 amended to read:
14 235.435 Funds for comprehensive educational plant
15 needs; construction cost maximums for school district capital
16 projects.--Allocations from the Public Education Capital
17 Outlay and Debt Service Trust Fund to the various boards for
18 capital outlay projects shall be determined as follows:
19 (3)(a) Each district school board shall receive an
20 amount from the Public Education Capital Outlay and Debt
21 Service Trust Fund to be calculated by computing the capital
22 outlay full-time equivalent membership as determined by the
23 department. Such membership must include, but is not limited
24 to:
25 1. K-12 students, except hospital and homebound
26 part-time students; and
27 2. Students who are workforce development education
28 students, and adult disabled students and who are enrolled in
29 school district technical centers.

1 The capital outlay full-time equivalent membership shall be
2 determined for kindergarten through the 12th grade and for
3 vocational-technical centers by averaging the unweighted
4 full-time equivalent student membership for the second and
5 third surveys and comparing the results on a school-by-school
6 basis with the Florida Inventory for School Houses. The
7 capital outlay full-time equivalent membership by grade level
8 organization shall be used in making the following
9 calculations: The capital outlay full-time equivalent
10 membership by grade level organization for the 1981-1982
11 fiscal year shall be computed as the base year. The capital
12 outlay full-time equivalent membership by grade level
13 organization for the 1984-1985 fiscal year shall be computed
14 with the positive increase over the base year constituting
15 growth. However, for those school districts in which school
16 concurrency has been adopted, growth capital outlay full-time
17 membership shall be determined by student population growth as
18 projected based on existing and anticipated development
19 according to the school concurrency plan. From the total
20 amount appropriated by the Legislature pursuant to this
21 subsection, 40 percent shall be allocated among the base
22 capital outlay full-time equivalent membership and 60 percent
23 among the growth capital outlay full-time equivalent
24 membership. The allocation within each of these groups shall
25 be prorated to the districts based upon each district's
26 percentage of base and growth capital outlay full-time
27 membership. The most recent 4-year capital outlay full-time
28 equivalent membership data shall be used in each subsequent
29 year's calculation for the allocation of funds pursuant to
30 this subsection. If the growth capital outlay full-time
31 equivalent membership for a district declines in any year used

1 in their calculation after the initial allocation pursuant to
2 this subsection, no allocation for growth capital outlay
3 full-time equivalent membership shall be made for any
4 subsequent year until the number of capital outlay full-time
5 equivalent membership has exceeded the number for which an
6 allocation has already been made. If a change, correction, or
7 recomputation of data during any year results in a reduction
8 or increase of the calculated amount previously allocated to a
9 district, the allocation to that district shall be adjusted
10 correspondingly. If such recomputation results in an increase
11 or decrease of the calculated amount, such additional or
12 reduced amounts shall be added to or reduced from the
13 district's future appropriations. However, no change,
14 correction, or recomputation of data shall be made subsequent
15 to 2 years following the initial annual allocation.
16 (b) Funds accruing to a district school board from the
17 provisions of this section shall be expended on needed
18 projects as shown by survey or surveys under the rules of the
19 State Board of Education or by adopted school concurrency
20 plans.
21 Section 2. This act shall take effect July 1, 1999.
