11  Senator Latvala moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 15, lines 25 through 30, delete those lines

15

16  and insert:

17         Section 4.  The agency is directed to adopt rules, with

18  the input of the technical assistance panel, to implement the

19  findings of the study described in section 2 of this act. In

20  addition to the matters to be considered by the agency under

21  section 120.54(3)(b), Florida Statutes, the agency shall adopt

22  rules for the following:

23         (1)  The quality of care standards appropriate for

24  hospitals, health systems, group practices, and sole providers

25  for diagnostic imaging services;

26         (2)  For providers that are not currently accredited,

27  the agency shall designate by rule requirements for hospitals,

28  health systems, group practices, and sole providers providing

29  diagnostic imaging services to participate in nationally

30  accredited organizations, to comply with the standards set by

31  national accreditation organizations;

 1         (3)  The number and extent of periodic inspections for

 2  hospitals, health systems, group practices, and sole providers

 3  of diagnostic imaging services that should be conducted and

 4  are not currently being conducted for the practice settings

 5  described in section 2 of this act;

 6         (4)  The standards needed to ensure appropriate

 7  utilization of diagnostic imaging services for hospitals,

 8  health systems, group practices, and sole providers that are

 9  not currently required in one or more of the practice settings

10  described in section 2 of this act;

12  The rules shall be filed for final adoption pursuant to

13  section 120.54(3)(e), Florida Statutes, not later than July 1,

14  2000.

15         Section 5.  If final rules have not been adopted by the

16  agency by July 1, 2000, group practices and sole practitioners

17  may accept up to 25 percent of their patients from outside

18  referrals for diagnostic imaging, provided that each such

19  group practice and each sole practitioner who wishes to

20  increase their outside referrals to 25 percent must comply

21  with the proposed rules of the agency until final rules are

22  adopted.
