1 A bill to be entitled
2 An act relating to motor vehicle airbags;
3 providing a short title; providing definitions;
4 requiring a record of any sale, replacement, or
5 installation of an airbag; specifying required
6 information; providing for inspection and
7 disclosure of such records; prohibiting certain
8 activities; providing penalties; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Airbag Antitheft Act.--
14 (1) SHORT TITLE.--This section may be cited as the
15 "Airbag Antitheft Act."
16 (2) DEFINITIONS.--As used in this section, the term
17 "airbag" means an inflatable restraint system that is designed
18 to be installed and to operate in a motor vehicle to activate
19 in the event of a crash; and a "salvaged airbag" is one which
20 has been removed from a motor vehicle.
21 (3) SALE OF SALVAGED AIRBAGS; REPLACEMENT OF AIRBAGS;
22 RECORDS.--Any person who purchases or sells any salvaged
23 airbag or replaces an airbag shall maintain a manual or
24 electronic record of the transaction, which shall include the
25 identification number of the airbag; the vehicle
26 identification number of the vehicle from which a salvaged
27 airbag was removed, if known; the name, address, and driver
28 license number or other means of identification of the person
29 from whom a salvaged airbag was purchased; and to whom an
30 airbag is sold or for whom an airbag is replaced. Such record
31 shall be made available for inspection upon demand by any law

1 enforcement officer of this state or other authorized
2 representative of the agency charged with administration of
3 this section. Upon request, information within a portion of
4 such record pertaining to a specific transaction shall be
5 provided to an insurer or a consumer.
6 (4) PROHIBITION; PENALTIES.--
7 (a) It is unlawful for any person to knowingly
8 possess, sell, or install a stolen uninstalled airbag, any
9 airbag from which the manufacturer's part identification
10 number has been removed, altered, or defaced, or an airbag
11 taken from a stolen motor vehicle. Any person who violates
12 this provision commits a felony of the third degree,
13 punishable as provided in s. 775.082, s. 775.083, or s.
14 775.084, Florida Statutes.
15 (b) Any person who fails to maintain complete and
16 accurate records or prepare complete and accurate documents
17 required by this act commits a misdemeanor of the first
18 degree, punishable as provided in s. 775.082 or s. 775.083,
19 Florida Statutes.
20 Section 2. This act shall take effect October 1, 1999.
