11  The Committee on Governmental Oversight and Productivity

12  recommended the following amendment:

14         Senate Amendment (with title amendment) 

15         On page 11, between lines 4 and 5,

16

17  insert:

18         Section 10.  Subsection (2) of section 455.601, Florida

19  Statutes, is created to read:

20         455.601  Hepatitis B or human immunodeficiency

21  carriers.--

22         (1)  The department and each appropriate board within

23  the Division of Medical Quality Assurance shall have the

24  authority to establish procedures to handle, counsel, and

25  provide other services to health care professionals within

26  their respective boards who are infected with hepatitis B or

27  the human immunodeficiency virus.

28         (2)  Any person licensed by the department and any

29  other person employed by a health care facility who contracts

30  a blood-borne infection shall have a rebuttable presumption

31  that the illness was contracted in the course and scope of his

 1  or her employment when the person reports one or more specific

 2  significant exposures to the infection as defined in s.

 3  381.004. The employer may rebut the presumption by the

 4  preponderance of the evidence. Except as expressly provided in

 5  this subsection, there shall be no presumption that such

 6  infection is a job-related illness.

13         On page 2, line 8, after the semicolon

15  insert:

16         amending s. 455.601, F.S.; providing that

17         certain licensees and employees of health care

18         facilities who contract blood-borne infections

19         have a rebuttable presumption that the illness

20         was contracted in the course of employment

21         under certain circumstances;
