1 A bill to be entitled
2 An act relating to mental health services;
3 amending s. 409.26731, F.S.; authorizing the
4 department to certify funds for state match for
5 certain children's mental health services;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Section 409.26731, Florida Statutes, is
11 amended to read:
12 409.26731 Certification of local funds as state match
13 for federally funded services; federal waivers.--In order to
14 implement Specific Appropriations 330 and 334 through 352 of
15 the 1997-1998 General Appropriations Act, The Department of
16 Children and Family Services is authorized to certify local
17 funds not to exceed $5 million as state match for children's
18 mental health services funded by Medicaid in excess of the
19 amount of state general revenue matching funds appropriated
20 for such services through the 1997-1998 General Appropriations
21 Act. The department is also authorized to certify local funds
22 not to exceed $5 million as state match for eligible Title
23 IV-E services for children under the supervision and custody
24 of the state in excess of the amount of state general revenue
25 matching funds appropriated for such services by the 1997-1998
26 General Appropriations Act in Specific Appropriations 334
27 through 352. Federal Medicaid or Title IV-E funds provided to
28 the state as federal financial participation consequent to
29 certified local matching funds shall automatically be passed
30 through to the local jurisdiction that provided the certified
31 local match. All of the provisions of this section are based

1 upon federal approval of the provisions as specifically
2 limited in this section and shall not become effective if any
3 further modifications are required of the state. The Agency
4 for Health Care Administration is authorized to apply for
5 federal waivers to modify the state Medicaid plan to include
6 optional Medicaid in-home and therapeutic services for
7 Medicaid-eligible children if the state match for such
8 services is provided by local funds certified by the
9 department as state match. Such services shall be available
10 only in communities that provide the certified match.
11 Section 2. This act shall take effect July 1, 1999.
