17 Section 22. For the purpose of implementing Specific
18 Appropriation 1656 of the 1999-2000 General Appropriations
19 Act, paragraph (k) of subsection (2) of section 110.205,
20 Florida Statutes, is amended to read:
21 110.205 Career service; exemptions.--
22 (2) EXEMPT POSITIONS.--The exempt positions which are
23 not covered by this part include the following, provided that
24 no position, except for positions established for a limited
25 period of time pursuant to paragraph (h), shall be exempted if
26 the position reports to a position in the career service:
27 (k)1. All officers and employees in the office of the
28 Governor, including all employees at the Governor's mansion,
29 and employees within each separate budget entity, as defined
30 in chapter 216, assigned to the Governor. Unless otherwise
31 fixed by law, the salary and benefits of these positions shall

1 be set by the department as follows:
2 a.1. The chief of staff, the assistant or deputy chief
3 of staff, general counsel, Director of Legislative Affairs,
4 inspector general, Director of Cabinet Affairs, Director of
5 Press Relations, Director of Planning and Budgeting, director
6 of administration, director of state-federal relations, and
7 chief prosecutor of the statewide grand jury, and the director
8 of each separate budget entity shall have their salaries and
9 benefits established by the department in accordance with the
10 rules of the Senior Management Service.
11 b.2. The salaries and benefits of positions not
12 established in sub-subparagraph a. subparagraph 1. shall be
13 set by the employing agency. Salaries and benefits of
14 employees whose professional training is comparable to that of
15 licensed professionals under paragraph (q), or whose
16 administrative responsibility is comparable to a bureau chief
17 shall be set by the Selected Exempt Service. The department
18 shall make the comparability determinations. Other employees
19 shall have benefits set as if career service employees.
20 2. For the 1999-2000 fiscal year only, all officers
21 and employees in the office of the Governor, including all
22 employees at the Governor's mansion, and employees within each
23 separate budget entity, as defined in chapter 216, assigned to
24 the Governor. Unless otherwise fixed by law, the salary and
25 benefits of these positions shall be set by the department as
26 follows:
27 a. The chief of staff, the assistant or deputy chief

4 Deputy Director of Planning and Budgeting, policy
5 coordinators, and the director of each separate budget entity
6 shall have their salaries and benefits established by the
7 department in accordance with the rules of the Senior
8 Management Service.
9 b. The salaries and benefits of positions not
10 established in sub-subparagraph a. shall be set by the
11 employing agency. Salaries and benefits of employees whose
12 professional training is comparable to that of licensed
13 professionals under paragraph (q), or whose administrative
14 responsibility is comparable to a bureau chief shall be set by
15 the Selected Exempt Service. The department shall make the
16 comparability determinations. Other employees shall have
17 benefits set comparable to legislative staff, except that
18 leave shall be comparable to career service.
19 c. This subparagraph expires July 1, 2000.
