11  Senator Dyer moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 24, following line 31,

15

16  insert:

17         Section 31.  In order to implement Specific

18  Appropriation 154 of the 1999-2000 General Appropriations Act,

19  subsection (3) of section 240.3341, Florida Statutes, is

20  amended to read:

21         240.3341  Incubator facilities for small business

22  concerns.--

23         (3)(a)  The incubator facility and any improvements to

24  the facility shall be owned by the community college.  The

25  community college may charge residents of the facility all or

26  part of the cost for facilities, utilities, and support

27  personnel and equipment.  No small business concern shall

28  reside in the incubator facility for more than 5 calendar

29  years.  The state shall not be liable for any act or failure

30  to act of any small business concern residing in an incubator

31  facility pursuant to this section or of any such concern

 1  benefiting from the incubator facilities program.

 2         (b)  Notwithstanding any provision of paragraph (a) to

 3  the contrary, and for the 1999-2000 fiscal year only, the

 4  incubator facility may be leased by the community college.

 5  This paragraph is repealed on July 1, 2000.
