13         Senate Amendment (with title amendment) 

14         On page 12, between lines 12 and 13,

15

16  insert:

17         Section 5.  Subsection (4) is added to section

18  403.7185, Florida Statutes, to read:

19         403.7185  Lead-acid battery fees.--

20         (4)  At least 15 percent of the revenues collected

21  annually from the lead-acid battery fees shall be designated

22  by the Department of Environmental Protection as grant moneys

23  to provide funding for contamination assessment and

24  remediation of sites contaminated by the disposal of lead-acid

25  batteries and the components thereof and to provide incentives

26  to assist recycling facilities for lead-acid batteries and

27  other lead-containing solid waste products in providing a

28  convenient opportunity for their safe recycling and proper

29  disposal. The Legislature recognizes a need for providing a

30  capability within the state for responding to the recycling,

31  proper disposal, and remediation of waste products generated

 1  by users of lead-containing products within the state.

 2  Incentive grants may be made for funding public or private

 3  activities that are innovative or necessary to maintain

 4  environmental compliance with federal and state regulatory

 5  requirements. This subsection expires July 1, 2004, unless

 6  reenacted by the Legislature.
