1 A bill to be entitled
2 An act relating to affordable housing; amending
3 s. 212.055, F.S.; authorizing any county that
4 is designated as an area of critical state
5 concern and that levies the tourist impact tax
6 to use a specified percentage of the local
7 government infrastructure surtax for the
8 purpose of constructing affordable housing;
9 providing for future repeal of such provision;
10 amending s. 420.9073, F.S., relating to the
11 distribution of moneys from the Local
12 Government Housing Trust Fund; providing for
13 any county that is designated as an area of
14 critical state concern and that levies the
15 tourist impact tax to receive an increased
16 percentage of funds; requiring that such funds
17 be used to construct affordable housing within
18 the county; providing an effective date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Present paragraphs (h) and (i) of
23 subsection (2) of section 212.055, Florida Statutes, 1998
24 Supplement, are redesignated as paragraphs (i) and (j),
25 respectively, and a new paragraph (h) is added to that
26 subsection, to read:
27 212.055 Discretionary sales surtaxes; legislative
28 intent; authorization and use of proceeds.--It is the
29 legislative intent that any authorization for imposition of a
30 discretionary sales surtax shall be published in the Florida
31 Statutes as a subsection of this section, irrespective of the

1 duration of the levy. Each enactment shall specify the types
2 of counties authorized to levy; the rate or rates which may be
3 imposed; the maximum length of time the surtax may be imposed,
4 if any; the procedure which must be followed to secure voter
5 approval, if required; the purpose for which the proceeds may
6 be expended; and such other requirements as the Legislature
7 may provide. Taxable transactions and administrative
8 procedures shall be as provided in s. 212.054.
9 (2) LOCAL GOVERNMENT INFRASTRUCTURE SURTAX.--
10 (h) Notwithstanding paragraph (d), any county that is
11 designated as an area of critical state concern and that
12 levies the tourist impact tax under s. 125.0108 may use 30
13 percent of the proceeds and interest of the local government
14 infrastructure surtax for the purpose of constructing
15 affordable housing within the county. This paragraph is
16 repealed on July 1, 2004.
17 Section 2. Present subsection (4) of section 420.9073,
18 Florida Statutes, 1998 Supplement, is redesignated as
19 subsection (5) and a new subsection (4) is added to that
20 section, to read:
21 420.9073 Local housing distributions.--
22 (4) Notwithstanding any other provision of this
23 section, any county that is designated as an area of critical
24 state concern and that levies the tourist impact tax under s.
25 125.0108 shall receive an increase of 20 percent in the
26 county's guaranteed amount provided under this section. Funds
27 provided under this subsection shall be used for the purpose
28 of constructing affordable housing within the county.
29 Section 3. This act shall take effect July 1, 1999.

4 CS for SB 2538 differs from the bill in the following ways:
5 Creates paragraph (h) of s. 212.055(2), F.S., to allow any
county that is designated as an area of critical state concern
6 and that levies the tourist impact tax to use 30 percent of
the proceeds from the local government infrastructure surtax
7 for constructing affordable housing; and
8 Creates subsection (4) of s. 420.9073, F.S., to allow any
county that is designated as an area of critical state concern
9 and that levies the tourist impact tax to receive an increase
of 20 percent in the county's guaranteed State Housing
10 Initiative Partnership (SHIP) Program allocation, to be used
for constructing affordable housing.
