  1                      A bill to be entitled

  2         An act relating to public records; providing an

  3         exemption from public records requirements for

  4         certain records and information used in an

  5         application for financial assistance from the

  6         Florida Commercial Space Financing Corporation;

  7         providing an expiration date; providing a

  8         finding of public necessity; providing a

  9         contingent effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  The personal financial records, trade

14  secrets, or proprietary information of an applicant for

15  financial assistance under sections 331.370-331.379, Florida

16  Statutes, are exempt from the disclosure provisions of Section

17  24(a) of Article I of the State Constitution and section

18  119.07(1), Florida Statutes. This exemption is subject to the

19  Open Government Sunset Review Act in accordance with section

20  119.15, Florida Statutes, and expires on October 2, 2004,

21  unless reviewed and reenacted by the Legislature.

22         Section 2.  The Legislature finds that it is a public

23  necessity that the personal financial records, trade secrets,

24  or proprietary information that may be provided to the Florida

25  Commercial Space Financing Corporation by an applicant for

26  financial assistance under sections 331.370-331.379, Florida

27  Statutes, be held confidential in order to protect the

28  premature disclosure of information that would adversely

29  affect business interests. Furthermore, the Legislature finds

30  that it would be an invasion of privacy for this

  1  competition-sensitive and proprietary information to be

  2  revealed to the public.

  3         Section 3.  This act shall take effect on the effective

  4  date of SB 2540 or similar legislation, relating to the

  5  commercial space industry, and shall not take effect if that

  6  legislation does not become a law.
