1 A bill to be entitled
2 An act relating to financial matters; creating
3 s. 215.245, F.S.; authorizing the state and
4 agencies or political subdivisions thereof to
5 enter into hold harmless agreements with the
6 Federal Government when required by federal law
7 to obtain federal funding; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 215.245, Florida Statutes, is
13 created to read:
14 215.245 Contracts with Federal Government;
15 indemnification authorized in certain circumstances.--The
16 state and its political subdivisions thereof, which are
17 authorized to enter into cooperative agreements or otherwise
18 contract with the Federal Government, are authorized to enter
19 into agreements to indemnify and hold harmless the Federal
20 Government or agencies thereof for damages, losses, costs, and
21 expenses caused by the negligent or intentional wrongdoing of
22 its officers, agents, servants, or employees, when required by
23 federal law in order to obtain federal funds or the benefits
24 from such funds, provided that the Federal Government or
25 agencies thereof, in the same contract, agree to indemnify and
26 hold harmless the state and its political subdivisions for
27 damages, losses, costs, and expenses caused by the negligent
28 or intentional wrongdoing of its officers, agents, servants,
29 or employees. In each case, the obligation for indemnification
30 must remain subject to adequate appropriations being available
31 to the indemnifying party.

1 Section 2. This act shall take effect upon becoming a
2 law.

5 LEGISLATIVE SUMMARY

Provides that the state and its agencies and political
7 subdivisions, which are authorized to enter into
cooperative agreements or otherwise contract with the
8 Federal Government, are authorized to indemnify and hold
harmless the Federal Government or agencies thereof in
9 such agreements or contracts when required by federal law
in order to obtain federal funds or the benefit of such
10 funds.
