13         Amendment (with title amendment) 

14         On page 33, between lines 13 & 14, of the bill

15

16  insert:

17         Section 11.06  Solid waste.--In accordance with section

18  403.706(1), Florida Statutes, the board of county

19  commissioners shall have the responsibility to transport

20  municipal solid waste to a solid waste disposal facility of

21  the county or to operate a solid waste facility. The

22  municipality must, through September 30, 2002, deliver the

23  solid waste collected within the municipality to either a

24  county solid waste transfer station or a county solid waste

25  disposal facility, as determined by the board. For the

26  remainder of the term of the county's solid waste haulout

27  contract, the board and the municipality shall negotiate for

28  the delivery of the solid waste collected within the

29  municipality by interlocal agreement. The parties shall

30  negotiate in good faith and with primary consideration given

31  to the minimum waste generation guarantees set forth in the

 2  may the board charge the municipality a tipping fee in excess

 3  of the tipping fee established annually and charged to other

 4  municipalities and persons delivering solid waste to the

 5  county transfer stations or county solid waste disposal

 6  facility.
