11  Senator Grant moved the following amendment:

13         Senate Amendment 

14         On page 4, line 12, through

15            page 5, line 12, delete those lines

16

17  and insert:  be executed in the manner prescribed by

18  department rule provided by law and must contain in the lower

19  left-hand corner of the first page the name, address, and

20  telephone number of the preparer of the original and, if

21  prepared by an attorney licensed in this state, the preparer's

22  Florida Bar membership number.  The receipt of such electronic

23  transfer constitutes delivery to the department as required by

24  law.

25         (4)  Notwithstanding any other provision of law, the

26  department may certify or acknowledge and electronically

27  transmit any record maintained by it.  The certification must

28  be evidenced by a certification code on each page transmitted

29  which must include the charter or filing number of the

30  document, date of transmission, and page number of the total

31  number of pages transmitted, and a sequential certification

 1  number assigned by the department which will identify the

 2  transmission and be available for verification of any

 3  transmitted acknowledgment or certified document.

 4         (5)  Notwithstanding any other provision of law, for

 5  the purposes of electronic filing If not otherwise provided by

 6  law the Department of State shall provide by rule determine:

 7         (a)  The appropriate format, which must be retrievable

 8  or reproducible in typewritten or printed form and must be

 9  legible.

10         (b)  The manner of execution, which may include any

11  symbol, manual, facsimile, conformed, or electronic signature

12  adopted by a person with the present intent to authenticate a

13  document.

14         (c)  The method of electronic transmission and fee

15  payment for any document placed under its jurisdiction for

16  filing or recordation.

17         (d)  The amount of any fee surcharge for the use of an

18  electronic filing format not inconsistent with s. 119.085.
