  1                      A bill to be entitled

  2         An act relating to probate; amending s.

  3         732.206, F.S.; providing that the elective

  4         share of a surviving spouse applies to assets

  5         held in an inter vivos trust; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

10         Section 1.  Section 732.206, Florida Statutes, is

11  amended to read:

12         732.206  Property entering into computation.--The

13  elective share shall be computed by taking into account all

14  property of the decedent wherever located which that is

15  subject to administration and all assets held in an inter

16  vivos trust except real property not located in Florida.

17         Section 2.  This act shall take effect October 1, 1999.

20                          SENATE SUMMARY

21    Provides that assets held in an inter vivos trust are
      part of the estate of a deceased spouse for purposes of
22    computing the elective share of a surviving spouse.
