17         Section 1.  (1)  SHORT TITLE.--This act may be cited as

18  the "Child Identification Program" or "ChIP" act of 1999.

19         (2)  LEGISLATIVE FINDINGS AND INTENT.--The Legislature

20  finds that the new technology of DNA testing is of great

21  potential benefit to the citizens of this state.  Having a

22  child's DNA sample available will enable parents to better

23  assist law enforcement in finding and identifying a child in

24  the unfortunate event of a child's disappearance or abduction,

25  as well as identifying children who may be victims in an

26  accident or natural disaster. Obtaining a DNA sample simply

27  requires the placement of a drop of blood on specially treated

28  paper for long term storage. It is the intent of the

29  Legislature that health care providers that choose to

30  participate in ChIP, including hospitals, birthing centers,

31  and physicians, shall assist parents in obtaining the DNA

 1  sample and that all costs associated with obtaining,

 2  maintaining, and retrieving the sample shall be borne by the

 3  parents.

 4         (3)  PARTICIPATION BY HOSPITALS AND BIRTHING

 5  CENTERS.--Every licensed hospital and every licensed birthing

 6  center that chooses to participate in ChIP shall, upon

 7  admission for a labor and delivery, notify and provide

 8  literature to the parent, as part of the admission process,

 9  that the hospital or birthing center is a participant in ChIP

10  and that the hospital or birthing center will provide a DNA

11  sample for identification purposes, upon request. The hospital

12  or birthing center shall obtain the DNA sample and provide for

13  storage and for retrieval of the sample when required.

14  Nothing in this section shall be considered as a health

15  service under the Medicaid program and the fee paid shall not

16  be subject to the copayment limitations set forth in s.

17  409.9081. No copy or record of any DNA sample that is created

18  or maintained by any entity participating in ChIP shall be

19  reproduced for any purpose other than as provided in this

20  section.

21         (4)  PARTICIPATION BY PHYSICIANS.--The Legislature

22  hereby encourages all physicians who provide primary care to

23  children born prior to the implementation of ChIP to

24  voluntarily participate and offer ChIP to their patients.  The

25  Board of Medicine is encouraged to assist licensed physicians

26  in learning about and participating in ChIP.

27         (5)  COSTS.--All costs associated with obtaining,

28  maintaining, and retrieving DNA samples shall be borne by the

29  parents requesting the sample.

30         Section 2.  This act shall take effect upon becoming a

31  law.

11         of the Child Identification Program; requiring

12         hospitals and birthing centers to provide

13         identification services upon request;

14         prohibiting the reproduction of certain

15         records; encouraging physicians to participate

16         in the Child Identification Program; providing

17         for costs; providing an effective date.
