11  Senator Kirkpatrick moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 1, between lines 9 and 10,

15

16  insert:

17         Section 1.  Subsections (2) and (3) of section 20.15,

18  Florida Statutes, 1998 Supplement, are amended to read:

19         20.15  Department of Education.--There is created a

20  Department of Education.

21         (2)  COMMISSIONER OF EDUCATION.--The head of the

22  Department of Education is the Commissioner of Education who

23  shall be elected by vote of the qualified electors of the

24  state pursuant to s. 5, Art. IV of the State Constitution.

25         (a)  The Commissioner of Education shall appoint a

26  Deputy Commissioner for Educational Programs who has such

27  powers, duties, responsibilities, and functions as are

28  necessary to ensure the greatest possible coordination,

29  efficiency, and effectiveness of kindergarten through

30  12th-grade education and vocational and continuing education

31  programs, including workforce development.

 1         (b)  The Commissioner of Education shall appoint a

 2  Deputy Commissioner for Planning, Budgeting, and Management

 3  who has such powers, duties, responsibilities, and functions

 4  as are necessary to ensure the greatest possible coordination

 5  of policies, programs, and procedures for the statewide system

 6  of education and the department.

 7         (c)  The Commissioner of Education shall appoint a

 8  Deputy Commissioner for Technology and Administration who has

 9  such powers, duties, responsibilities, and functions as are

10  necessary to ensure the greatest possible coordination and

11  development of technological supports for the education system

12  and efficient administration of the department.

13         (3)  DIVISIONS.--The following divisions of the

14  Department of Education are established:

15         (a)  Division of Community Colleges.

16         (b)  Division of Public Schools and Community

17  Education.

18         (c)  Division of Universities.

19         (d)  Division of Workforce Development.

20         (e)  Division of Human Resource Development.

21         (f)  Division of Administration.

22         (g)  Division of Financial Services.

23         (h)  Division of Support Services.

24         (i)  Division of Technology.

25         Section 2.  The Commissioner of Education is authorized

26  to establish, abolish, or consolidate bureaus, sections, and

27  subsections and to reallocate duties and functions and may

28  reassign positions in pay grade 25 and above to the Select

29  Exempt Service category within the Department of Education in

30  order to promote effective and efficient operation of the

31  department. Authorized positions and appropriations may be

 1  transferred from one budget entity to another as required to

 2  implement the reorganization. The provisions of this section

 3  are subject to the requirements of section 216.181, Florida

 4  Statutes. The commissioner may not establish, abolish, or

 5  consolidate bureaus, sections, or subsections after January

 6  31, 2000, unless such action is approved by the Legislature or

 7  by law. The commissioner shall provide a report on the

 8  reorganization to the President of the Senate, the Speaker of

 9  the House of Representatives, the Minority Leaders of the

10  Senate and the House of Representatives, and the chairmen of

11  the education and appropriations committees of the Legislature

12  by January 31, 2001. This section expires July 1, 2000.
