17 Section 1. Subsection (9) of section 636.003, Florida
18 Statutes, is amended to read:
19 636.003 Definitions.--As used in this act, the term:
20 (9) "Prepaid limited health service organization" means any
21 person, corporation, partnership, or any other entity which,
22 in return for a prepayment, undertakes to provide or arrange
23 for, or provide access to, the provision of a limited health
24 service to enrollees through a an exclusive panel of
25 providers. Prepaid limited health service organization does
26 not include:
27 (a) An entity otherwise authorized pursuant to the
28 laws of this state to indemnify for any limited health
29 service;
30 (b) A provider or entity when providing limited health
31 services pursuant to a contract with a prepaid limited health

1 service organization, a health maintenance organization, a
2 health insurer, or a self-insurance plan; or
3 (c) Any person who, in exchange for fees, dues,
4 charges or other consideration, provides access to a limited
5 health service provider without assuming any responsibility
6 for payment for the limited health service or any portion
7 thereof.
8 Section 2. Subsection (2) of section 636.016, Florida
9 Statutes, is amended to read:
10 636.016 Prepaid limited health service contracts.
11 (2) Every prepaid limited health service organization
12 shall provide each subscriber a contract, a certificate,
13 membership card, or member handbook which must clearly state
14 all of the services to which a subscriber is entitled under
15 the contract and must include a clear and understandable
16 statement of any limitations on the services or kinds of
17 services to be provided, including any copayment feature or
18 schedule of benefits required by the contract or by any
19 insurer or entity which is underwriting any of the services
20 offered by the prepaid limited health service organization or
21 any limitations on services being received from a non-panel
22 provider. The contract, certificate, provider listing, or
23 member handbook must also state where and in what manner the
24 health services may be obtained.
