11  Senator Lee moved the following amendment:

14         On page 3, line 28, through

15            page 4, line 12, delete those lines

16

17  and insert:  policy. However, if termination was the result of

18  failure to pay any required premium or contribution and such

19  nonpayment of premium was due to acts of an employer or

20  policyholder other than the employee or certificateholder,

21  written application for the converted policy must be made and

22  the first premium must be paid to the insurer not later than

23  63 days after notice of termination is mailed by the insurer

24  or the employer, whichever is earlier, to the employee's or

25  certificateholder's last address as shown by the record of the

26  insurer or the employer, whichever is applicable. In such case

27  of termination due to nonpayment of premium by the employer or

28  policyholder, the premium for the converted policy may not

29  exceed the rate for the prior group coverage for the period of

30  coverage under the converted policy prior to the date notice

31  of termination is mailed to the employee to certificateholder.
