3 within state government; amending s. 20.057,
4 F.S.; requiring that the Governor direct
5 executive agencies to enter into agreements to
6 combine training and staff-development
7 resources; providing for consolidated budget
8 requests; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 20.057, Florida Statutes, is
13 amended to read:
14 20.057 Interagency agreements to delete duplication of
15 inspections and encourage productive use of resources.--
16 (1) The Governor shall direct any department, the head
17 of which is an officer or board appointed by and serving at
18 the pleasure of the Governor, to enter into an interagency
19 agreement that will eliminate duplication of inspections among
20 the departments that inspect the same type of facility or
21 structure or that will combine separately funded training and
22 staff-development resources. Parties to the agreement may
23 include departments that which are headed by a Cabinet
24 officer, the Governor and Cabinet, or a collegial body. The
25 agreement shall:
26 (a) Authorize agents of one department to conduct
27 inspections required to be performed by another department.
28 (b) Specify that agents of the department conducting
29 the inspection have all powers relative to the inspection as
30 the agents of the department on whose behalf the inspection is
31 being conducted.

1 (c) Require that agents of the department conducting
2 the inspection have sufficient knowledge of statutory and
3 administrative inspection requirements to conduct a proper
4 inspection.
5 (d) Specify that the departments which have entered
6 into the agreement may neither charge nor accept any funds
7 with respect to duties performed under the agreement which are
8 in excess of the direct costs of conducting such inspections.
9 (e) Provide for developing a consolidated budget
10 request for the delivery of training and staff-development
11 services to multiple state agencies. The request may include
12 alternate delivery systems, including, but not limited to, the
13 delivery of services by a single state agency, use of
14 commercial services, or interactive training delivered from a
15 remote location.

17 Before taking effect, an agreement entered into under this
18 section must be approved by the Governor. Inspections
19 conducted under an agreement shall be deemed sufficient for
20 enforcement purposes pursuant to the agreement or as otherwise
21 provided by law.
22 (2) No later than 60 days prior to the beginning of
23 the regular session, the Governor shall make an annual report
24 to the President of the Senate and the Speaker of the House of
25 Representatives regarding interagency agreements. The report
26 shall identify each interagency agreement entered into under
27 this section, and, for each agreement, shall describe the
28 duplication eliminated, provide data that measures the
29 effectiveness of inspections conducted under the interagency
30 agreement, and estimate the cost savings that have resulted
31 from the agreement. The report shall also describe obstacles

1 encountered by any department in attempting to develop an
2 interagency agreement and in performing duties resulting from
3 an interagency agreement and shall recommend appropriate
4 remedial legislative action.
5 Section 2. This act shall take effect July 1, 1999.
