  1                      A bill to be entitled

  2         An act relating to opticianry; amending s.

  3         484.013, F.S.; authorizing an optician to

  4         determine the refractive powers of the human

  5         eyes under the direct supervision of a licensed

  6         opthalmologist; providing a penalty; providing

  7         an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (3) of section 484.013, Florida

12  Statutes, is amended to read:

13         484.013  Violations and penalties.--

14         (3)(a)  It is unlawful for any optician to engage in

15  the diagnosis of the human eyes, attempt to determine the

16  refractive powers of the human eyes except as provided in

17  paragraph (b), or, in any manner, attempt to prescribe for or

18  treat diseases or ailments of human beings.

19         (b)  An optician may determine the refractive powers of

20  the human eyes if the optician is making such determination

21  under the direct supervision of an ophthalmologist licensed

22  under chapter 458 or chapter 459.

23         (5)  Any person who violates a provision of this

24  section commits a misdemeanor of the second degree, punishable

25  as provided in s. 775.082 or s. 775.083.

26         Section 2.  This act shall take effect July 1, 1999.
