14 On page 4, line 7, through page 6, line 29, delete
15 those lines

17 and insert:
18 768.071 Business premises liability; areas outside
19 enclosed buildings.--Notwithstanding any other provision of
20 law to the contrary, a person or organization owning or
21 controlling an interest in a business premises shall be liable
22 for civil damages for the death of, or injury or damage to, an
23 invitee or guest caused by a criminal act committed by a
24 person who is not an employee or agent of the business and
25 occurring on part of the business premises that is not within
26 an enclosed building only if the person or organization owning
27 or controlling an interest in the business premises
28 disregarded his or her duty to protect invitees or guests on
29 the property. For purposes of this section a person or
30 organization owning or controlling an interest in a business
31 premises may be found to have disregarded his or her duty to

1 protect invitees or guests only if the person or organization
2 owning or controlling an interest in the business premises
3 knew that a criminal act was likely to occur on the portions
4 of the property that are not within an enclosed building and
5 failed to take any corrective action which could have
