1 A bill to be entitled
2 An act relating to bone marrow transplant
3 procedures; amending s. 627.4236, F.S.;
4 requiring that coverage for
5 bone-marrow-transplant procedures include costs
6 of the donor patient; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (2) of section 627.4236, Florida
12 Statutes, is amended to read:
13 627.4236 Coverage for bone marrow transplant
14 procedures.--
15 (2) An insurer or a health maintenance organization
16 may not exclude coverage for bone marrow transplant procedures
17 recommended by the referring physician and the treating
18 physician under a policy exclusion for experimental, clinical
19 investigative, educational, or similar procedures contained in
20 any individual or group health insurance policy or health
21 maintenance organization contract issued, amended, delivered,
22 or renewed in this state that covers treatment for cancer, if
23 the particular use of the bone marrow transplant procedure is
24 determined to be accepted within the appropriate oncological
25 specialty and not experimental pursuant to subsection (3).
26 Covered bone-marrow-transplant procedures must include costs
27 associated with the donor-patient to the same extent and
28 limitations as costs associated with the insured.
29 Section 2. This act shall take effect July 1, 1999.
