  1                      A bill to be entitled

  2         An act relating to the re-creation of the

  3         Preneed Funeral Contract Consumer Protection

  4         Trust Fund without modification; re-creating

  5         the Preneed Funeral Contract Consumer

  6         Protection Trust Fund; carrying forward current

  7         balances and continuing current sources and

  8         uses thereof; providing an effective date.

  9

10         WHEREAS, the Legislature wishes to extend the life of

11  the Preneed Funeral Contract Consumer Protection Trust Fund,

12  which is otherwise scheduled to be terminated pursuant to

13  constitutional mandate, and

14         WHEREAS, the Legislature has reviewed the Preneed

15  Funeral Contract Consumer Protection Trust Fund before its

16  scheduled termination date and has found that it continues to

17  meet an important public purpose, and

18         WHEREAS, the Legislature has found that existing public

19  policy concerning the Preneed Funeral Contract Consumer

20  Protection Trust Fund sets adequate parameters for its use,

21  NOW, THEREFORE,

23  Be It Enacted by the Legislature of the State of Florida:

24

25         Section 1.  (1)  The Preneed Funeral Contract Consumer

26  Protection Trust Fund within the Department of Banking and

27  Finance, FLAIR number 44-2-536, which was created by section

28  497.413, Florida Statutes, and which is to be terminated

29  pursuant to Section 19(f), Article III of the State

30  Constitution on November 4, 2000, is re-created.

  1         (2)  All current balances of the trust fund are carried

  2  forward, and all current sources and uses of the trust fund

  3  are continued.

  4         Section 2.  This act shall take effect November 4,

  5  2000.
