  1                      A bill to be entitled

  2         An act relating to trust funds; re-creating the

  3         Alcoholic Beverage and Tobacco Trust Fund

  4         within the Department of Business and

  5         Professional Regulation without modification;

  6         carrying forward current balances and

  7         continuing current sources and uses thereof;

  8         providing an effective date.

  9

10         WHEREAS, the Legislature wishes to extend the life of

11  the Alcoholic Beverage and Tobacco Trust Fund within the

12  Department of Business and Professional Regulation, which is

13  otherwise scheduled to be terminated pursuant to

14  constitutional mandate, and

15         WHEREAS, the Legislature has reviewed the Alcoholic

16  Beverage and Tobacco Trust Fund within the Department of

17  Business and Professional Regulation before its scheduled

18  termination date and has found that it continues to meet an

19  important public purpose, and

20         WHEREAS, the Legislature has found that existing public

21  policy concerning the Alcoholic Beverage and Tobacco Trust

22  Fund within the Department of Business and Professional

23  Regulation sets adequate parameters for its use, NOW,

24  THEREFORE,

26  Be It Enacted by the Legislature of the State of Florida:

27

28         Section 1.  (1)  The Alcoholic Beverage and Tobacco

29  Trust Fund within the Department of Business and Professional

30  Regulation, FLAIR number 79-2-022, which was created by

31  section 561.025, Florida Statutes, and which is to be

  1  terminated pursuant to Section 19(f), Article III of the State

  2  Constitution on November 4, 2000, is re-created.

  3         (2)  All current balances of the Alcoholic Beverage and

  4  Tobacco Trust Fund within the Department of Business and

  5  Professional Regulation are carried forward, and all current

  6  sources and uses of the trust fund are continued.

  7         Section 2.  This act shall take effect November 4,

  8  2000.
