  1                      A bill to be entitled

  2         An act relating to trust funds; re-creating the

  3         Division of Florida Land Sales, Condominiums,

  4         and Mobile Homes Trust Fund within the

  5         Department of Business and Professional

  6         Regulation without modification; carrying

  7         forward current balances and continuing current

  8         sources and uses thereof; providing an

  9         effective date.

11         WHEREAS, the Legislature wishes to extend the life of

12  the Division of Florida Land Sales, Condominiums, and Mobile

13  Homes Trust Fund within the Department of Business and

14  Professional Regulation, which is otherwise scheduled to be

15  terminated pursuant to constitutional mandate, and

16         WHEREAS, the Legislature has reviewed the Division of

17  Florida Land Sales, Condominiums, and Mobile Homes Trust Fund

18  within the Department of Business and Professional Regulation

19  before its scheduled termination date and has found that it

20  continues to meet an important public purpose, and

21         WHEREAS, the Legislature has found that existing public

22  policy concerning the Division of Florida Land Sales,

23  Condominiums, and Mobile Homes Trust Fund within the

24  Department of Business and Professional Regulation sets

25  adequate parameters for its use, NOW, THEREFORE,

26

27  Be It Enacted by the Legislature of the State of Florida:

28

29         Section 1.  (1)  The Division of Florida Land Sales,

30  Condominiums, and Mobile Homes Trust Fund within the

31  Department of Business and Professional Regulation, FLAIR

  1  number 79-2-289, which was created by section 498.019, Florida

  2  Statutes, and which is to be terminated pursuant to Section

  3  19(f), Article III of the State Constitution on November 4,

  4  2000, is re-created.

  5         (2)  All current balances of the trust fund are carried

  6  forward, and all current sources and uses of the trust fund

  7  are continued.

  8         Section 2.  This act shall take effect November 4,

  9  2000.
