1 House Memorial
2 A memorial to the Congress of the United
3 States, urging action by the U.S. Department of
4 the Army, Corps of Engineers, Jacksonville
5 Division, and Region IV of the Environmental
6 Protection Agency, relating to wetland
7 jurisdiction.

9 WHEREAS, the State of Florida has implemented a
10 statewide streamlined wetland delineation methodology that
11 does not compromise wetland protection and provides a unified
12 definition and methodology binding all state, regional, and
13 local governments and agencies, and
14 WHEREAS, the federal delineation methodology results in
15 a slightly different wetland line in certain areas than the
16 unified statewide methodology for the delineation of wetlands,
17 and
18 WHEREAS, the state wishes to ensure continued
19 coordination with federal wetland planning and regulation
20 without unnecessary duplication, needless paperwork, and
21 delays, and
22 WHEREAS, the federal agencies' use of the Florida
23 statewide unified wetland delineation methodology would
24 eliminate substantial transactional costs, NOW, THEREFORE,

26 Be It Resolved by the Legislature of the State of Florida:
27
28 That the State of Florida supports action by the U.S.
29 Congress, the congressional delegation from Florida, the
30 Administrator and Regional Administrator for Region IV of the
31 United States Environmental Protection Agency, the Secretary

1 of the Army, and the District Engineer for the Jacksonville
2 Division of the Corps of Engineers that would result in the
3 federal agencies implementing section 404 of the Clean Water
4 Act and section 10 of the Rivers and Harbors Act adopting and
5 using Florida's statewide wetland definition and delineation
6 methodology.
7 BE IT FURTHER RESOLVED that copies of this memorial be
8 dispatched to the President of the United States, to the
9 President of the United States Senate, to the Speaker of the
10 United States House of Representatives, and to each member of
11 the Florida delegation to the United States Congress.
