3 short title; amending s. 232.032, F.S.; adding
4 a disease for which immunization is required
5 for school attendance; providing an effective
6 date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. This act may be cited as the "Jonathon Ryan
11 Atchison Immunization Act of 1999."
12 Section 2. Subsection (1) of section 232.032, Florida
13 Statutes, 1998 Supplement, is amended to read:
14 232.032 Immunization against communicable diseases;
15 school attendance requirements; exemptions.--
16 (1) The Department of Health may adopt rules necessary
17 to administer and enforce this section. The Department of
18 Health, after consultation with the Department of Education,
19 shall adopt rules governing the immunization of children
20 against, the testing for, and the control of preventable
21 communicable diseases. The rules must include procedures for
22 exempting a child from immunization requirements.
23 Immunizations shall be required for poliomyelitis, diphtheria,
24 rubeola, rubella, pertussis, mumps, tetanus, varicella, and
25 other communicable diseases as determined by rules of the
26 Department of Health. The manner and frequency of
27 administration of the immunization or testing shall conform to
28 recognized standards of medical practice. The Department of
29 Health shall supervise and secure the enforcement of the
30 required immunization. Immunizations required by this section

1 shall be available at no cost from the county health
2 departments.
3 (2) The school board of each district and the
4 governing authority of each nonpublic school shall establish
5 and enforce as policy that, prior to admittance to or
6 attendance in a public or nonpublic school, grades preschool
7 through 12, each child present or have on file with the school
8 a certification of immunization for the prevention of those
9 communicable diseases for which immunization is required by
10 the Department of Health and further shall provide for
11 appropriate screening of its pupils for scoliosis at the
12 proper age. Such certification shall be made on forms approved
13 and provided by the Department of Health and shall become a
14 part of each student's permanent record, to be transferred
15 when the student transfers, is promoted, or changes schools.
16 The transfer of such immunization certification by Florida
17 public schools shall be accomplished using the Florida
18 Automated System for Transferring Education Records and shall
19 be deemed to meet the requirements of this section.
20 Section 3. This act shall take effect October 1 of the
21 year in which enacted.
