21 (4) The following license plate annual use fees shall
22 be collected for the appropriate specialty license plates:
23 (z) Adopt-a-Child license plate, $20.
24 Section 2. Subsection (26) is added to section
25 320.08058, Florida Statutes, 1998 Supplement, to read:
26 320.08058 Specialty license plates.--
27 (26) Adopt-a-Child.--
28 (a) The department shall develop an Adopt-a-Child
29 license plate as provided in this section. The word "Florida"
30 must appear at the bottom of the plate, and the words
31 "Adopt-a-Child" must appear at the top of the plate.

1 (b) The annual use fees shall be distributed annually
2 to each county in the ratio that the annual use fees collected
3 by each county bears to the total fees collected for the
4 plates within the state. Each county shall distribute the
5 funds to nongovernmental, not-for-profit agencies within the
6 county, which agencies' services provide counseling and
7 meeting the physical needs of pregnant women who are committed
8 to placing their children for adoption. Funds may be
9 distributed to any certified agency that is involved or
10 associated with promoting adoption or foster care.
11 1. Agencies that receive the funds must use at least
12 70 percent of the funds to provide for the material needs of
13 pregnant women who are committed to placing their children for
14 adoption, including clothing, housing, medical care, food,
15 utilities, and transportation. Such funds may also be expended
16 on infants awaiting placement with adoptive parents.
17 2. The remaining funds may be used for adoption,
18 counseling, training, or advertising, but may not be used for
19 administrative expenses, legal expenses, or capital
20 expenditures.
21 3. Each agency that receives such funds must submit an
22 annual audit, prepared by a certified public accountant, to
23 the county. The county may conduct a consolidated audit in
24 lieu of the annual audit. The Office of Program Policy
25 Analysis and Government Accountability shall review the
26 expenditure of funds every 3 years to ensure that funds are
27 expended in accordance with this subsection. Any unused funds
28 that exceed 10 percent of the funds received by an agency
29 during its fiscal year must be returned to the county, which
30 shall distribute them to other qualified agencies.
31 Section 3. This act shall take effect July 1, 1999.
