1 A bill to be entitled
2 An act relating to administrative fines;
3 providing for deposit of fines collected by
4 executive-branch agencies into the General
5 Revenue Fund; providing that any fine, penalty,
6 or settlement agreement costs collected by an
7 agency in the executive branch must be
8 implemented from specific statutory authority;
9 requiring that specified rules must be adopted
10 pursuant to the Administrative Procedure Act;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Notwithstanding any other provision of law,
16 the proceeds from any fine levied and collected by an agency
17 in the executive branch of state government shall be deposited
18 into the General Revenue Fund.
19 Section 2. Any fine, penalty, or settlement agreement
20 costs collected by an agency in the executive branch must be
21 implemented from specific statutory authority and, if
22 described or referenced in rule, such rule must be adopted
23 pursuant to the Administrative Procedure Act. A fine,
24 penalty, or settlement agreement costs may not be imposed
25 based solely upon program guidance or agency policy.
26 Section 3. This act shall take effect July 1, 2000.
