2 An act relating to Medicaid; amending s.
3 409.904, F.S.; providing eligibility for
4 preventive family planning services for persons
5 who meet certain criteria, subject to specific
6 federal authorization; directing the Agency for
7 Health Care Administration to seek federal
8 waivers as necessary; providing an effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsections (6) and (7) of section 409.904,
14 Florida Statutes, 1998 Supplement, are renumbered as
15 subsections (7) and (8), respectively, and a new subsection
16 (6) is added to said section to read:
17 409.904 Optional payments for eligible persons.--The
18 agency may make payments for medical assistance and related
19 services on behalf of the following persons who are determined
20 to be eligible subject to the income, assets, and categorical
21 eligibility tests set forth in federal and state law. Payment
22 on behalf of these Medicaid eligible persons is subject to the
23 availability of moneys and any limitations established by the
24 General Appropriations Act or chapter 216.
25 (6) Subject to specific federal authorization, a
26 person who is or may be sexually active who is not otherwise
27 eligible for medical assistance and whose income is at or
28 below 200 percent of the most current federal poverty level is
29 eligible to receive preventive family planning services,
30 pursuant to s. 409.905(3).

1 Section 2. The Agency for Health Care Administration
2 shall submit such waiver applications to the United States
3 Department of Health and Human Services as may be necessary to
4 secure federal authorization and financial participation for
5 the provisions of preventive family planning services pursuant
6 to s. 409.904(6), Florida Statutes, as provided by this act.
7 Section 3. This act shall take effect July 1, 1999.

10 HOUSE SUMMARY

Subject to specific federal authorization, authorizes
12 preventive family planning services under the Medicaid
program for certain low-income persons who are or may be
13 sexually active and who are not otherwise eligible for
medical assistance. Directs the Agency for Health Care
14 Administration to submit federal waiver applications as
necessary.
