14         On page 1, lines 24-28, delete those lines

16  and insert:

17  or the court's own motion, except:

18         1.  If a defendant was previously offered admission to

19  a pretrial substance abuse education and treatment

20  intervention program and the defendant rejected that offer on

21  the record at least 30 days after the date of the defendant's

22  arraignment for the same charge, then the court or the state

23  attorney may deny the defendant's admission to such a program.
