1 A bill to be entitled
2 An act re-creating the Air Pollution Control
3 Trust Fund of the Department of Environmental
4 Protection without modification; carrying
5 forward current balances and continuing current
6 sources and uses thereof; providing an
7 effective date.

9 WHEREAS, the Legislature wishes to extend the life of
10 the Air Pollution Control Trust Fund, which is otherwise
11 scheduled to be terminated pursuant to constitutional mandate,
12 and
13 WHEREAS, the Legislature has reviewed the Air Pollution
14 Control Trust Fund before its scheduled termination date and
15 has found that it continues to meet an important public
16 purpose, and
17 WHEREAS, the Legislature finds that the existing public
18 policy concerning the Air Pollution Control Trust Fund sets
19 adequate parameters for its use, NOW, THEREFORE,
20
21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. (1) The Air Pollution Control Trust Fund,
24 within the Department of Environmental Protection, FLAIR
25 number 37-2-035, which is to be terminated pursuant to Section
26 19(f), Article III of the State Constitution on November 4,
27 2000, is re-created.
28 (2) All current balances of the trust fund are carried
29 forward, and all current sources and uses of the trust fund
30 are continued.

1 Section 2. This act shall take effect November 4,
2 2000.
