  1                      A bill to be entitled

  2         An act re-creating the Federal Law Enforcement

  3         Trust Fund within the Department of

  4         Environmental Protection without modification;

  5         carrying forward current balances and

  6         continuing current sources and uses thereof;

  7         repealing s. 20.2553(3), F.S.; abrogating the

  8         future termination of the trust fund; providing

  9         an effective date.

11         WHEREAS, the Legislature wishes to extend the life of

12  the Federal Law Enforcement Trust Fund within the Department

13  of Environmental Protection, which is otherwise scheduled to

14  be terminated pursuant to constitutional mandate, and

15         WHEREAS, the Legislature has reviewed the trust fund

16  before its scheduled termination date and has found that it

17  continues to meet an important public purpose, and

18         WHEREAS, the Legislature has found that existing public

19  policy concerning the trust fund sets adequate parameters for

20  its use, NOW, THEREFORE,

22  Be It Enacted by the Legislature of the State of Florida:

23

24         Section 1.  (1)  The Federal Law Enforcement Trust

25  Fund, FLAIR number 37-2-719, which was created within the

26  Department of Environmental Protection and which is to be

27  terminated pursuant to Section 19(f), Article III of the State

28  Constitution on July 1, 2002, is re-created.

29         (2)  All current balances of the trust fund are carried

30  forward, and all current sources and uses of the trust fund

31  are continued.

  1         Section 2.  Subsection (3) of section 20.2553, Florida

  2  Statutes, as created by section 1 of chapter 98-390, Laws of

  3  Florida, is repealed.

  4         Section 3.  This act shall take effect July 1, 2002.
