1 A bill to be entitled
2 An act relating to assisted living facilities;
3 amending s. 400.408, F.S.; requiring the
4 unlicensed facility to cease operation upon
5 notification by the Agency for Health Care
6 Administration; providing a penalty; providing
7 an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraphs (e) through (h) of subsection
12 (1) of section 400.408, Florida Statutes, 1998 Supplement, are
13 redesignated as paragraphs (f) through (i), respectively, and
14 a new paragraph (e) is added to said subsection to read:
15 400.408 Unlicensed facilities; referral of person for
16 residency to unlicensed facility; penalties; verification of
17 licensure status.--
18 (1)
19 (e) Upon notification by the agency pursuant to this
20 subsection, a person who is operating an unlicensed assisted
21 living facility must cease such operation until such time as a
22 license for the operation of the facility is issued. Any
23 person who violates this paragraph commits a felony of the
24 third degree, punishable as provided in s. 775.082, s.
25 775.083, or s. 775.084.
26 Section 2. This act shall take effect October 1, 1999.
