1 A bill to be entitled
2 An act relating to the re-creation of the
3 Minerals Trust Fund without modification;
4 re-creating the trust fund; carrying forward
5 current balances and continuing current sources
6 and uses thereof; repealing s. 2, ch. 94-198,
7 Laws of Florida, as amended; abrogating
8 provisions relating to the termination of the
9 trust fund; providing an effective date.

11 WHEREAS, the Legislature wishes to extend the life of
12 the Minerals Trust Fund, which is otherwise scheduled to be
13 terminated pursuant to constitutional mandate, and
14 WHEREAS, the Legislature has reviewed the trust fund
15 before its scheduled termination date and has found that it
16 continues to meet an important public purpose, and
17 WHEREAS, the Legislature has found that existing public
18 policy concerning the trust fund sets adequate parameters for
19 its use, NOW, THEREFORE,

21 Be It Enacted by the Legislature of the State of Florida:

23 Section 1. (1) The Minerals Trust Fund, FLAIR number
24 37-2-499, which was created within the Department of
25 Environmental Protection and which is to be terminated
26 pursuant to Section 19(f), Article III of the State
27 Constitution on November 4, 2000, is re-created.
28 (2) All current balances of the trust fund are carried
29 forward, and all current sources and uses of the trust fund
30 are continued.

1 Section 2. Effective upon this act becoming a law,
2 section 2 of chapter 94-198, Laws of Florida, as amended by
3 section 73 of chapter 96-321, Laws of Florida, is repealed.
4 Section 3. Except as otherwise provided in this act,
5 this act shall take effect November 4, 2000.
