  1                      A bill to be entitled

  2         An act relating to trust funds; declaring the

  3         findings of the Legislature that specified

  4         trust funds are exempt from the termination

  5         requirements of s. 19(f), Art. III of the State

  6         Constitution; amending s. 11.2423, F.S.;

  7         providing that acts declaring trust funds

  8         exempt from such requirements are not repealed

  9         by the adoption of the Florida Statutes;

10         providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  The Legislature finds that the following

15  trust funds are exempt from termination pursuant to Section

16  19(f), Article III of the State Constitution:

17         (1)  Within the Department of Agriculture and Consumer

18  Services, those trust funds of the department declared to be

19  exempt by chapter 95-227, Laws of Florida.

20         (2)  Within the Department of Banking and Finance,

21  those trust funds of the department declared to be exempt by

22  chapter 95-227, Laws of Florida.

23         (3)  Within the Department of Education:

24         (a)  Those trust funds of the department declared to be

25  exempt by chapter 95-227, Laws of Florida.

26         (b)  The Construction Trust Fund, School for the Deaf

27  and Blind, FLAIR number 48-2-137.

28         (c)  The Ancillary Facilities Construction Trust Fund,

29  FLAIR number 49-2-026.

30         (d)  The Building Fee Trust Fund, FLAIR number

31  49-2-064.

  1         (e)  The Contracts, Grants, and Donations Trust Fund,

  2  FLAIR number 49-2-153.

  3         (4)  Within the Department of Environmental Protection,

  4  those trust funds of the department declared to be exempt by

  5  chapter 95-374, Laws of Florida.

  6         (5)  Within the Department of Insurance:

  7         (a)  The Treasurer Investment Trust Fund, FLAIR number

  8  46-2-728.

  9         (b)  The State Treasurer Escrow Trust Fund, FLAIR

10  number 46-2-622.

11         (c)  The Treasury Cash Deposit Trust Fund, FLAIR number

12  46-2-720.

13         (d)  The Agents and Solicitors County Tax Trust Fund,

14  FLAIR number 46-2-024.

15         (6)  Within the Department of Revenue:

16         (a)  Those trust funds of the department declared to be

17  exempt by chapter 95-227, Laws of Florida.

18         (b)  The Revenue-Fuel Tax Refund Payments Trust Fund,

19  FLAIR number 73-2-317.

20         (c)  The Sales Tax Security Deposit Trust Fund, FLAIR

21  number 73-2-465.

22         (d)  The Secondhand Dealer and Secondary Metals

23  Recycler Clearing Trust Fund, FLAIR number 73-2-617.

24         (e)  The Highway Safety-Admin. Div. Security Deposits

25  Trust Fund, FLAIR number 73-2-625.

26         (f)  The Special Fuel Security Deposit Trust Fund,

27  FLAIR number 73-2-649.

28         Section 2.  Section 11.2423, Florida Statutes, is

29  amended to read:

30         11.2423  Laws or statutes not repealed.--

  1         (1)  No special or local statute, or statute, local,

  2  limited or special in its nature, shall be repealed by the

  3  Florida Statutes, now or hereafter adopted, and, for the

  4  purpose of this saving from repeal any statute of the

  5  following classes shall be taken to be included in such

  6  exception, namely:

  7         (a)  Any statutes for or concerning only a certain

  8  county or certain designated counties.

  9         (b)  Any statute for, or concerning or operative in

10  only a portion of the state.

11         (c)  Any statute for or concerning only a certain

12  municipal corporation.

13         (d)  Any statute for or concerning only a designated

14  individual corporation or corporations.

15         (e)  Any statute incorporating a designated individual

16  corporation, or making a grant thereto.

17         (f)  Any statute of such limited or local application

18  as makes its inclusion in a general statute impracticable or

19  undesirable.

20         (g)  Road designation laws.

21         (h)  Severability section in any law.

22         (i)  Any act of the Legislature declaring a trust fund

23  to be exempt from termination pursuant to s. 19(f), Art. III

24  of the State Constitution.

25         (2)  The foregoing enumeration of classes of statutes

26  not repealed shall not be construed to imply a repeal of other

27  statutes which are local, limited or special in their nature.

28         Section 3.  This act shall take effect upon becoming a

29  law.

  2                          SENATE SUMMARY

  3    Declares various trust funds to be exempt from the
      automatic termination requirements of s. 19(f), Art. III
  4    of the State Constitution. Provides that the adoption of
      the Florida Statutes does not operate to repeal acts
  5    declaring trust funds to be exempt from such
      requirements.
