1 A bill to be entitled
2 An act relating to local government
3 comprehensive planning; amending s. 163.3187,
4 F.S.; providing that the limitation on the
5 frequency of amendments to a local government's
6 comprehensive plan does not apply to amendments
7 necessary to establish public school
8 concurrency; providing that all local
9 government public school facilities elements
10 within a county shall be prepared and adopted
11 on a similar time schedule; providing an
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Paragraph (h) is added to subsection (1) of
17 section 163.3187, Florida Statutes, 1998 Supplement, to read:
18 163.3187 Amendment of adopted comprehensive plan.--
19 (1) Amendments to comprehensive plans adopted pursuant
20 to this part may be made not more than two times during any
21 calendar year, except:
22 (h) Any comprehensive plan amendment to establish
23 public school concurrency pursuant to s. 163.3180(12),
24 including, but not limited to, adoption of a public school
25 facilities element and adoption of amendments to the capital
26 improvements element. In order to ensure the consistency of
27 all local government public school facilities elements within
28 a county with each other, such elements shall be prepared and
29 adopted on a similar time schedule.
30 Section 2. This act shall take effect upon becoming a
31 law.

Provides that the limitation on the frequency of

does not apply to amendments necessary to establish
