14 On page 2, lines 17-27, delete those lines
15
16 and insert: furnished under contract. Notwithstanding the
17 provisions of s. 215.425, all documented federal funds earned
18 for the current fiscal year by the department and
19 community-based agencies which exceed the amount appropriated
20 by the Legislature shall be distributed to all entities that
21 contributed to the excess earnings based on a schedule and
22 methodology developed by the department and approved by the
23 Executive Office of the Governor. Distribution shall be pro
24 rata based on total earnings and shall be made only to those
25 entities that contributed to excess earnings. Excess earnings
26 of community-based agencies shall be used only in the district
27 in which they were earned. Additional state funds appropriated
28 by the Legislature for community-based agencies or made
29 available pursuant to the budgetary amendment process
30 described in s. 216.177 shall be transferred to the
31 community-based agencies. The department shall amend a

1 community-based agency's contract to permit expenditure of the
2 funds. The distribution program applies only to entities that
3 were under privatization contracts as of July 1, 1999. This
4 program is authorized for a period of 3 years beginning July
5 1, 1999, and ending June 30, 2002. The Office of Program
6 Policy Analysis and Government Accountability shall review
7 this program and report to the Legislature by December 31,
8 2001. The review shall assess the program to determine how the
9 additional resources were used, the number of additional
10 clients served, the improvements in quality of service
11 attained, the performance outcomes associated with the
12 additional resources, and the feasibility of continuing or
13 expanding this program. The methodology must provide for the
