2 An act relating to drug testing of students;
3 amending s. 230.23005, F.S., relating to
4 supplemental powers and duties of school
5 boards; authorizing mandatory, random drug
6 testing of students under certain
7 circumstances; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (1) of section 230.23005,
12 Florida Statutes, 1998 Supplement, is amended to read:
13 230.23005 Supplemental powers and duties of school
14 board.--The school board may exercise the following
15 supplemental powers and duties. Any provision of chapters 228,
16 229, 231, 232, 233, 234, 235, and this chapter prevails over
17 any conflicting provision of this section. The rules adopted
18 under this section must not be inconsistent with the
19 provisions of chapters 228, 229, 231, 232, 233, 234, 235, and
20 this chapter.
21 (1) STUDENT MANAGEMENT.--The school board may adopt
22 programs and policies to ensure the safety and welfare of
23 individuals, the student body, and school personnel, which
24 programs and policies may:
25 (a) Prohibit the possession of weapons and drugs on
26 campus, student hazing, and other activities that could
27 threaten the operation of the school or the safety and welfare
28 of the student body or school personnel.
29 (b) Require random drug testing of all students, if
30 the board finds that the testing is necessary for the safety
31 or welfare of the student body or school personnel.

1 (c)(b) Require uniforms to be worn by the student
2 body, or impose other dress-related requirements, if the board
3 finds that those requirements are necessary for the safety or
4 welfare of the student body or school personnel.
5 (d)(c) Provide procedures for student dismissal
6 precautions and for granting permission for students to leave
7 school grounds during school hours, including releasing a
8 student from school upon request by a parent or guardian or
9 for public appearances of school groups.
10 (e)(d) Provide procedures for managing protests,
11 demonstrations, sit-ins, walk-outs, or other acts of civil
12 disobedience.
13 (f)(e) Provide procedures for detaining students and
14 for readmission of students after expulsion.
15 (g)(f) Regulate student automobile use and parking.
16 Section 2. This act shall take effect July 1, 1999.
