11  Senator Campbell moved the following amendment:

13         Senate Amendment 

14         On page 2, lines 2-19, delete those lines

15

16  and insert:  c. and the recorded governing documents provide

17  for an adult, senior, or retirement housing facility or

18  community and the governing documents lack an amendatory

19  procedure, prohibit amendments, or restrict amendments until a

20  specified future date, then that housing facility or community

21  shall be deemed housing for older persons intended and

22  operated for occupancy by persons 55 years of age or older. If

23  those documents further provide a prohibition against

24  residents 16 years of age or younger, that provision shall be

25  construed, for purposes of the Fair Housing Act, to only apply

26  to residents 18 years of age or younger, in order to conform

27  with federal law requirements. Governing documents which can

28  be amended at a future date must be amended and properly

29  recorded within 1 year after that date to reflect the

30  requirements for consideration as housing for older persons,

31  if that housing facility or community intends to continue as
