  2         An act relating to training centers;

  3         establishing training school consolidation

  4         pilot projects; providing for transfer of

  5         responsibility for the operation of existing

  6         programs; providing for the transfer of real

  7         property; providing program requirements;

  8         providing for exemptions from statutes and

  9         rules; providing for funding of pilot training

10         centers; providing a guideline for the future

11         approval of programs; requiring a study;

12         providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15

16         Section 1.  Training school consolidation pilot

17  projects.--

18         (1)  ESTABLISHMENT.--To consolidate and more

19  efficiently use state and taxpayer resources by combining

20  training programs, pilot training centers shall be established

21  to combine existing law enforcement, corrections, fire

22  fighter, officer, and public criminal justice training in

23  Lake, Leon, Pinellas, and St. Johns Counties. The following

24  pilot training centers are established:

25         (a)  The Ken Bragg Center at Lake-Sumter Community

26  College.

27         (b)  The Pat Thomas Center at Tallahassee Community

28  College.

29         (c)  The Criminal Justice Academy at St. Johns River

30  Community College.

  1         (d)  The Criminal Justice Training Center at St.

  2  Petersburg Community College.

  3         (2)  EXISTING PUBLIC CRIMINAL JUSTICE TRAINING

  4  PROGRAMS.--In the pilot counties, responsibility for the

  5  operation of existing public criminal justice training

  6  programs will be shifted from the school district to the

  7  community college in whose service area the public criminal

  8  justice training program is located.  Ownership of existing

  9  school district-owned public criminal justice training program

10  real property will be transferred to the respective community

11  college. Lease of state-owned public criminal justice training

12  program real property will be transferred to the respective

13  community college.

14         (3)  PROGRAM REQUIREMENTS.--Each pilot training center

15  will be regional in nature, as defined by the Criminal Justice

16  Standards and Training Commission and the Firefighters

17  Standards and Training Council. Each pilot training center

18  must obtain from the Criminal Justice Standards and Training

19  Commission and the Firefighters Standards and Training Council

20  a certificate of compliance for those components of the newly

21  established pilot training center for which that body

22  currently provides uniform policies and procedures.  The

23  certificate of compliance will be granted based upon

24  compliance with applicable standards and the following

25  requirements.  Each community college board of trustees must:

26         (a)  Establish a pilot training center advisory

27  committee made up of professionals from the field of each

28  training program included in the pilot project.

29         (b)  Adopt a schedule for reimbursement to the school

30  district, from funds provided by the Legislature specifically

31  for that purpose, for loss of actual profits from funds

  1  received through the Florida Education Finance Program and for

  2  documented local funds previously expended in the facility for

  3  purposes of public criminal justice training.

  4         (c)  Provide certificate and noncredit options for

  5  students and training components of the pilot training center

  6  that so require.

  7         (d)  Develop an articulation agreement with the state

  8  university system to facilitate the transfer of graduates of a

  9  community college degree training program to the upper

10  division of a state university with a corresponding program.

12  The community college board of trustees may provide for school

13  district public criminal justice training staff employed in

14  full-time budgeted positions to be transferred into the

15  community college personnel system at the same rate of salary.

16  Retirement and leave provisions will be transferred according

17  to law.

18         (4)  EXEMPTIONS FROM STATUTES AND RULES.--To facilitate

19  the utilization of innovative training methods, the Criminal

20  Justice Standards and Training Commission or the Firefighters

21  Standards and Training Council shall waive, upon the request

22  of the community college board of trustees, any provisions of

23  law or rule which prohibits the pilot training center from

24  utilizing that innovative training method.  The Criminal

25  Justice Standards and Training Commission and the Firefighters

26  Standards and Training Council shall have waiver jurisdiction

27  over those components of the pilot training center course or

28  program for which that body currently provides uniform

29  standards and policies.

30         (5)  FUNDING.--Beginning July 1, 1999, the Department

31  of Education shall shift all funds generated by students in

  1  the pilot training centers established by this section,

  2  including FTE, recurring, and nonrecurring funds, from the

  3  appropriate school district to the respective community

  4  college. The community college shall qualify for future

  5  facilities funding dollars upon transfer of the facility.

  6         (6)  GUIDING PRINCIPLES.--In the future, it shall be

  7  the policy of the Criminal Justice Standards and Training

  8  Commission and the Firefighters Standards and Training Council

  9  to approve public criminal justice training programs based

10  upon the principle that programs that serve students who have

11  received a high school diploma, or its equivalent, shall be

12  administered under the governance of the appropriate

13  postsecondary system.  Those programs that serve students who

14  have not received a high school diploma, or its equivalent,

15  shall be administered under the governance of the appropriate

16  public school system. Students enrolled for these purposes may

17  qualify under dual enrollment provisions.

18         (7)  STUDY.--The Criminal Justice Standards and

19  Training Commission and the Firefighters Standards and

20  Training Council shall jointly review and analyze alternative

21  training methods utilized by the pilot training centers.  The

22  State Board of Community Colleges and the Office of the

23  Auditor General shall jointly conduct a 5-year longitudinal

24  study of the effect of the pilot programs relative to cost and

25  efficiency.  A report on the pilot training centers shall be

26  submitted to the President of the Senate and the Speaker of

27  the House of Representatives no later than January 1, 2004.

28         Section 2.  This act shall take effect upon becoming a

29  law.
